Please read these terms carefully before using FitZ.
By downloading, installing, or using the FitZ mobile application ("App") or website, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use FitZ.
1. Acceptance of Terms
These Terms constitute a legally binding agreement between you and FitZ ("Company", "we", "us", or "our"). By accessing or using our services, you confirm that you are at least 13 years old and have the legal capacity to enter into these Terms.
2. Description of Service
FitZ provides a health and fitness tracking platform including:
- Food and calorie tracking
- Water intake logging
- Activity and step tracking
- Social features (friends, challenges, leaderboards)
- Health insights and analytics (Premium)
- Streak and achievement systems
3. Account Registration
To use FitZ, you must create an account. You agree to:
- Provide accurate and complete information during registration
- Keep your password secure and confidential
- Notify us immediately of any unauthorized access
- Be responsible for all activities under your account
- Not share your account with others
4. Health Disclaimer
FitZ is a fitness and nutrition tracking tool. It is NOT a medical service. The information provided by FitZ:
- Is for general informational purposes only
- Does not constitute medical advice, diagnosis, or treatment
- Should not replace professional medical advice
- May not be accurate for individuals with specific medical conditions
Always consult a qualified healthcare professional before starting any diet or exercise program, especially if you have existing health conditions.
5. Premium Subscriptions
Billing
Premium subscriptions are billed in advance on a monthly or yearly basis. Payments are processed securely through Razorpay.
Cancellation
You may cancel your subscription at any time. Access continues until the end of the current billing period. No partial refunds are provided.
Refunds
Refunds are available within 7 days of purchase if you have not used Premium features. Contact support@fitzapp.in to request a refund.
Price Changes
We reserve the right to change subscription prices with 30 days notice. You may cancel if you do not agree to new pricing.
6. Referral Program
FitZ offers a referral program where you earn benefits for referring new users. Referral rewards:
- Are subject to change or termination at any time
- Cannot be exchanged for cash
- May not be combined with other offers
- Are subject to abuse prevention measures
7. User Conduct
You agree not to:
- Use FitZ for any unlawful purpose
- Harass, abuse, or harm other users
- Create fake accounts or impersonate others
- Attempt to hack, reverse engineer, or exploit the app
- Share inappropriate content in social features
- Manipulate challenge scores or leaderboards dishonestly
8. Intellectual Property
All content, features, and functionality of FitZ — including but not limited to text, graphics, logos, and software — are owned by FitZ and protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.
9. Data and Privacy
Your use of FitZ is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using FitZ, you consent to our data practices as described in the Privacy Policy.
10. Limitation of Liability
To the maximum extent permitted by law, FitZ shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of data or business interruption
- Any damages arising from your use of health/nutrition information
- Third-party actions or content
11. Termination
We reserve the right to terminate or suspend accounts that violate these Terms, engage in fraudulent activity, or misuse our services. You may delete your account at any time from the app settings.
12. Governing Law
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Hyderabad, Telangana, India.
13. Changes to Terms
We may update these Terms from time to time. Significant changes will be communicated via email or in-app notification. Continued use constitutes acceptance of updated Terms.
